A man who filmed two women as they visited the toilets at a Perth night spot has been put on the sex offenders register.
Jacek Siewierski was caught leaning over the top of a cubicle at City Nightclub to film the shocked pair, aged 21 and 22.
The 42-year-old claimed he’d mistakenly blundered into the ladies thinking it was the gents, and told police officers he simply wanted to “record the truth” that the women had been in the wrong toilets.
Sheriff Robert McCreadie told the accused, who appeared before him at Perth Sheriff Court on Thursday, he found it difficult to believe the incident had been innocent.
“I have no doubt that there was a significant sexual element to this offence,” he said.
Siewierski, of Perth Road, Stanley, admitted conducting himself in a disorderly manner at the South Methven Street venue last October by setting up a video recording device in a cubicle in the ladies’ toilets, to the fear and alarm of club goers, and committing a breach of the peace.
Depute fiscal Stuart Richardson said the victims had gone to the female toilet at around 12.30am.
“One of the ladies used the toilet within one of the cubicles and had finished doing that when she and her friend heard what they thought was a man’s voice nearby.Mobile phone”They looked up towards the top of the cubicle and saw the accused holding a mobile telephone.”
They immediately left the cubicle and reported the matter to a steward at the club.
Siewierski was approached by staff and ejected from the venue, with Tayside Police also being informed of the incident.
He was traced nearby and detained by officers, who found him to be in possession of a mobile phone, which was seized as evidence.
When examined, it was found to contain a short video clip showing the two women within the toilet cubicle, though “neither was in a state of undress or disarray” at the time.
Solicitor John McLaughlin told the court his client had been drinking that night and it had been his first visit to the club.
“He mistakenly entered the ladies toilet, believing it was the gents,” he said. “He accepts that whatever his thinking after that, his videoing of anyone in the adjoining cubicle was a breach of the peace.”
Siewierski will return to court for sentencing on May 18.
