A 49-year-old man has been found to have caused a schoolboy to look at a sexual image on his mobile phone.
John Wilson, of Kestrel Way, Perth, was unable to plead to the charge at Perth Sheriff Court because of his low IQ.
Sheriff Michael Fletcher found Wilson, 49, had committed the offence by causing a 15-year-old boy to look at a sexual image on his mobile phone on December 23 2011, while on a bus between Dundee and Perth.
Depute fiscal Robbie Brown told the court that there was “no alternative” to the sheriff’s decision.
“Your lordship heard what happened and what was said that day,” he told Sheriff Fletcher.
“And you know the accused’s position in terms of his IQ.”
Solicitor David Holmes, defending, conceded that the picture on the phone was found.
Sheriff Fletcher told Wilson: “I am satisfied that the facts of this case happened in the way they were explained.
“I find the facts were proved.”
Wilson was placed on the sex offenders register for a period yet to be determined and the case was adjourned until May 9 for a psychiatric report.
