Careless driver’s overtaking earns fine and points

A driver’s dodgy overtaking manoeuvres on the road near Glamis have cost him £600.

Michael Cusack was travelling on the A94 on October 17 last year when he became impatient behind slower traffic and pulled out.

But the 51-year-old was unaware a van was emerging from a junction and had to quickly pull back in.

Depute fiscal Hannah Kennedy told Forfar Sheriff Court a motorist travelling behind could clearly see the van driver was annoyed by the incident.

The following drivers then caught up with the accused some four miles along the road, just in time to see him execute another overtake before he had to pull in sharply to avoid oncoming traffic.

The fiscal said: “The witness was so concerned that he called police.”

Management consultant Cusack, 51, of The Stables, Cardean, Meigle, was reported to police and originally charged with dangerous driving, but admitted a reduced charge of careless driving.

Defence solicitor Bob Bruce said his client had a clean licence and drove around 20,000 miles a year.

“He accepts there was an error of judgment in the first incident and the person behind him was flashing his lights and was unhappy. This made him feel uncomfortable and he carried out another manoeuvre.

“He is generally a very careful driver, as evidenced by there being no penalty points on his licence.

“He lives rurally and could not carry on with his work if he lost his licence.”

In addition to the fine, Cusack received six penalty points on his licence.
