A 35-year-old man has had his BMW confiscated and been banned from driving for more than three years after failing to give a breath test.
David Robinson, Thirlmere Avenue, Abram, Wigan, was disqualified for 40 months and ordered to hand over the car said to be valued between £2,000 and £3,000 at Perth Sheriff Court yesterday.
Depute fiscal Bill Kermode told the court Robinson was seen by witnesses drinking with friends at The Fair O’Blair pub in Blairgowrie.
Witnesses became concerned he was drink-driving after they saw him slurring and unsteady on his feet, before driving off in his BMW.
The vehicle was traced at 1am on Lower Mill Street where it was found to be unsecured, with the keys in the ignition, although the engine was not running.
The accused was found in the Victoria Hotel and when he spoke to officers they described him as appearing heavily under the influence of alcohol.
Robinson then became verbally abusive and, when taken to Perth police station, he refused to give a specimen of breath but denied to say why.
Robinson’s solicitor said his client’s position was that he did not have a drink prior to entering the premises where he was spoken to by the police officers.
The accused admitted that on December 27 2014 at Lower Mill Street, Blairgowrie, he behaved in a threatening or abusive manner, shouted, swore and acted aggressively. He also pled guilty to failing to provide two specimens of breath for analysis required to ascertain his ability to drive.
Sheriff Fiona Tait also ordered Robinson to complete 300 hours unpaid work.
