Documents apparently showing a football agent was entitled to a cut of former Dundee United striker Johnny Russell’s future transfer fees have been presented to court.
Charles Duddy is suing the Premiership side for £75,000 as part of the transfer fee for Scotland squad striker Russell.
Duddy of Premier Sports Management International Ltd, Seafield Road, Broughty Ferry, is claiming the money as 10% of the £750,000 fee Derby County paid for Russell’s signature last year.
The striker’s former agent, who also represented Tangerines star Keith Watson, says a three-year contract had been agreed between the club and the player in February 2011.
Documents show that a clause in the player’s contract with Dundee United stated an agency fee of 10% of any future transfer was payable to the agent.
The player was also entitled to 10% of any fee for a move to another club.
However, Dundee United are rejecting the claims, stating that Duddy did not represent the player as he was not a licensed agent and say they had no contract with him.
At a previous hearing, Duddy’s legal team was asked to produce some form of contract or legal agreement with Dundee United and yesterday lawyers for the agent placed the new documentation before the court.
A solicitor for Dundee United said: “We are aware that the pursuers have intimated a very extensive amendment,” and asked that the hearing be continued for a week.
The document, presented on to court Tuesday, stated that a letter from Dundee United to Mr Duddy dated May 2 2011, bore to record his entitlement to be paid 10% of any future transfer fee received during the contract.
However, the document also stated the letter: “bore to impose an additional condition that entitlement to payment was to be ‘conditional on Premier Sports Management International Ltd continuing to act on behalf of Jonathon Russell as a Licensed Agent’.”
Duddy’s solicitor agreed to the continuation and Sheriff Tom Hughes set a date of March 25 for a new pre-proof hearing.
There will be a proof hearing on April 1.
