Man exposed himself and urinated beside Overgate restaurant

A man exposed himself in a busy shopping centre and urinated while people were eating nearby.

Dundee Sheriff Court heard that Murray Thomson, 48, was being escorted from the Overgate Shopping Centre by security staff at around 2pm on a Friday when he unzipped his jeans and exposed his genitals.

Thomson admitted he had exposed himself and urinated as he was being ushered towards the ground-floor doors, close to the Five Guys burger diner, where customers were eating lunch.

He denied there was any sexual element to his crime.

Depute fiscal Mohammad Sadiq told the court: “He was right in the city centre next to a fine dining restaurant.”

Defence solicitor Paul Parker Smith said Thomson, of Chirnside Place, had been taken out of the Overgate by two security guards.

He said: “He had been in the centre drinking. He is an alcoholic and has had an alcohol problem for a long time. He was at the doorway to Five Guys.

“There are no other public toilets near the centre so he took the chance to relieve himself there. There was no untoward sexual element to this.”

The court heard that Thomson, of Chirnside Place, had exposed himself after challenging staff at Sports Direct to fight, and had also been shouting and swearing.

He admitted behaving in a threatening and abusive manner during the incident, as well as the act of public indecency on January 15.

The court heard that at the time of the incident Thomson was on bail in connection with another offence.

Sheriff Elizabeth Munro told Thomson that she needed to protect the public from him.

She said: “I think about all those people round about in the shopping centre watching you behave like this.

“It’s not just the urination but the shouting and swearing, too.”

Sentence was deferred until March 8 and a report was ordered.

Thomson was granted bail in the meantime.
