Thousands of motorists could have their speeding convictions quashed after claims the authorities forgot to update road orders on three of Scotland’s trunk roads, The Courier can reveal.
Drivers caught speeding on Kingsway and Arbroath Road in Dundee and on a section of the Tay Road Bridge may have been wrongly convicted after the apparent blunders.
It’s thought speeding convictions were brought under outdated road orders, some of them dating back more than 20 years.
The chaotic situation, which could potentially affect tens of thousands of speeding drivers, was exposed by Dundee solicitor Kris Gilmartin, at the city’s JP court.
The trial of a local woman accused of driving at 53mph in a 30mph limit was dropped at the 11th hour by the Crown after Mr Gilmartin warned them the case had been prosecuted under a temporary order which ended three months previously.
Mr Gilmartin says historical road orders on Kingsway and the Dundee section of the A92 are also out of date and says several other cases he has dealt with have also been dropped by the Crown.
Police Scotland and the Crown Office say they are aware of the situation and are liaising with each other, but Dundee City Council and Transport Scotland say they are confident the current road orders are legal.
