Jail warning for driver whose crash while overtaking left man ‘fortunate to be alive’

A motorist could face jail for driving into the path of an oncoming car on a blind corner in Angus.

Michal Dulas, of Lordburn Place, Forfar, caused serious injuries to the driver of the other car on the A937 Montrose to Craigo road last July.

The other driver, a 45-year-old man, suffered a punctured lung, a scaphoid fracture to his wrist, a hip fracture, torn ankle ligaments and a metatarsal fracture.

At Forfar Sheriff Court Dulas, 33, was warned by Sheriff Gregor Murray that he could face a custodial sentence.

Depute fiscal Joanne Smith said: “Other drivers in a line of vehicles were aware of the accused repeatedly going into the opposing carriageway and overtaking.

“The accused again moved into the opposing carriageway and overtook two cars while going into the blind corner.

“It was a head-on collision with the other driver’s car. He had no time to take evasive action.”

She continued: “The other driver had serious leg injuries but the accused managed to leave his vehicle and appeared to be unharmed.

“The other driver was taken to Ninewells Hospital in Dundee by ambulance.”

Both vehicles were examined, and although they were extensively damaged, no mechanical defects were found that could have contributed to the collision.

When he was charged by police, Dulas said: “I understand that I was driving the wrong way and that I caused an accident.”

Sheriff Gregor Murray deferred sentence for a criminal justice social work report.

He told Dulas: “Your driving caused a very serious accident one which, from the photographs I have just seen, resulted in the victim’s car being damaged to such an extent that he is fortunate to be alive.”

He added: “You should be aware that a custodial sentence is a distinct possibility in this case.”

Dulas was disqualified from driving until he is sentenced on November 18.

Dulas admitted that on July 18 last year on the A937 Montrose to Craigo road, near to its junction with the U438 road to Logie, he drove a car dangerously by repeatedly moving into the opposing carriageway.

He admitted overtaking vehicles on a blind right-hand bend when it was unsafe to do so and colliding with another car, causing the other driver to suffer severe physical injuries.
