The trial of a Tayside police officer accused of assaulting a suspect more than three years ago started at Arbroath Sheriff Court on Wednesday.
Dean Miller, 29, denies that on June 18 2010 at Seaton Caravan Park, Arbroath, he assaulted Anthony Allan Davies by punching him on the face to his injury.
Miller, whose address was given as police headquarters in West Bell Street, Dundee, is also accused of attempting to pervert the course of justice by compiling a report against Mr Davies which omitted details of him being punched.
Miller was called to the dock for the trial to get under way but proceedings were immediately delayed due to procedural difficulties regarding a video link for Mr Davies to give evidence from HMP Durham.
Defence council Mark Stewart QC submitted that the link was incompetent as a procedural diet was required to set out the terms of evidence being taken by the link.
A letter of request, setting out the terms of the link, was then approved by Sheriff Gregor Murray in the afternoon.
The trial is scheduled to continue today, when Sheriff Murray indicated he would establish a protocol for taking the video evidence, with a view to it then being heard on Friday.
