Cousins jailed for possessing controlled drugs in Lochgelly

Two cousins have been jailed for drug dealing after a police raid on their Lochgelly home uncovered controlled substances with a street value of more than £3,000.

Appearing for sentencing at Dunfermline Sheriff Court were Robert Canning, 25, of Melville Street, Lochgelly and James Finlay, 36, of Malcolm Street, Ballingry.

They were both living at Canning’s flat at the time of the offences and were using amphetamine as well as selling it on.

They admitted that on June 18 last year at Melville Street, Lochgelly, they were in possession of cannabis, cannabis resin and amphetamine with intent to supply.

Depute fiscal Gary McMullan said police received intelligence that the property may contain controlled drugs.

A search warrant was then obtained and executed by officers at 7.50am on the morning in question.

When police entered the property, they saw Canning go to the rear window and throw two mobile phones into the garden.

When questioned, Canning told officers where drugs could be found in the flat, including in the freezer.

The officers recovered cannabis resin, herbal cannabis and amphetamine with respective street values of £1,907, £684 and £518.

Also found by officers searching the flat were two sets of scales and small bags officers believed were used for selling the drugs.

Canning told police he had panicked when the flat was raided and said that was the reason for him throwing the phones out of the window.

Canning’s solicitor, Iain McCafferty, said his client had cooperated with police and other agencies throughout.

He had since said he was “glad it happened” as he had been on a “downward spiral”.

“He’s acknowledged his wrong-doing from the outset,” said Mr McCafferty.

Solicitor for Finlay, James Moncrieff, said: “He was supplying friends to top up his habit.

“He was buying in bulk.

“He accepts he was selling it to workmates but using it himself.”

Sheriff Charles MacNair ordered the forfeiture of cash found in a jar and a safe totalling £1,749.

He sentenced both men to a period of four months’ imprisonment.
