A report has been submitted to the Crown Office over a near drowning at an open-air pool in the Mearns last year.
An 11-year-old boy from Aberdeen was pulled unconscious from the water at Stonehaven open-air pool in June.
He has since made a full recovery and underwater cameras have been installed in a bid to improve safety.
A Crown Office spokesman said: “A report has been submitted by the Health and Safety Executive to the COPFS’s health and safety division in connection with an incident at Stonehaven open-air swimming pool on June 28 2012.
“The report is under consideration by the health and safety division.”
The pool reopened for the summer season on Saturday and drew more than 1,000 visitors.
A spokeswoman for Aberdeenshire Council said: “We have been made aware that a report has been sent to the procurator fiscal.
“Aberdeenshire Council and the Friends of Stonehaven Pool aim to make the open-air swimming experience the best it can be.
“The installation of the latest safety equipment at the pool is part of our continuous drive to maintain the highest standard of safety at our leisure facilities.
“We would encourage visitors and residents to continue to make full use of these facilities throughout the summer.”
