A Montrose man who filmed a profoundly deaf pensioner while making sexual remarks has avoided jail.
Kevin Hector was sentenced to 100 hours of unpaid work at Arbroath Sheriff Court after posting footage of the vulnerable 69-year-old woman on Facebook.
The court heard the 24-year-old offshore worker, from Burnside Place, Montrose, had lost his job in the wake of media coverage of his case.
Sheriff Peter Paterson imposed a community payback order, demanding the work be carried out within six months as a direct alternative to a prison term.
He said: “Because of the calculated and selfish nature of the offence, if this work is not done there will be no second chance in this matter. I want this work to be done.”
Hector admitted enticing the pensioner into a friend’s house and carrying out the act on May 27.
Due to her disabilities the woman was unaware of what was unfolding and the matter only came to light after family members were told the video was on the internet.
Playing to the camera, Hector asked if the woman was aroused and asked her to perform a sex act on him.
The woman, who is only able to communicate through sign language and a range of vocal sounds, had been walking in Montrose when she was confronted.
Hector had been drinking heavily before the incident.
He was arrested and charged by police and admitted behaving in a threatening and abusive manner that was sexually aggravated.
Defence agent Nick Markowski said Hector had been dismissed by his employer after a copy of a newspaper featuring his case was handed to the HR department.
He added: “Mr Hector has asked me to apologise to the court once more for his actions on the day in question. He has donated £200 to the British Deaf Association and I would ask the court to take regard of the gesture he has made.”
