Fine and ban for Invergowrie driver found caked in mud and vomit

A motorist who was found with mud and vomit on his clothing in the Carse of Gowrie has been fined £700 at Perth Sheriff Court.

David McKenzie (45), of Main Street, Invergowrie, was discovered by police on an unclassified road between Kinfauns and Glencarse after police received an anonymous call at 1.45am on the day in question.

On Wednesday, McKenzie admitted that on April 13 at police divisional HQ, Perth, he failed to provide two breath specimens.

He also admitted that on the same day on an unclassified road between Kinfauns and Glencarse, he struggled with a PC, lashed out and struggled violently.

Depute fiscal Carol Whyte told the court that officers were on mobile patrol when they received the phone call about the accused.

She said: ”When officers found the accused he appeared to be under the influence of alcohol as his speech was very slurred.

”He was covered in mud and vomit and had been lying on a grass verge beside a car.”

The court heard McKenzie provided a roadside breath test that was positive and was then arrested.

However, as he was being taken to the police van he lashed out and fought with police.

Ms Whyte said: ”He was then taken to Perth police HQ where he failed to provide a breath test, telling officers ‘he couldn’t be bothered’.”

Solicitor Billy Sommerville, defending, said his client had been driving in his partner’s car.

”My client was using this car on the day in question,” he said. ”This happened in an isolated area, to the side of the road.”

In addition to the fine, McKenzie was banned from driving for 14 months.

A motion put forward by the Crown for forfeiture of the car was refused by Sheriff Michael Fletcher.
