An Angus man breached a court order for the fourth time when he broke into his former partner’s home and stole from his son.
Raymond Henderson, 41, was jailed after admitting breaking into the property on Provost Reid Road in Montrose between December 31 and January 2.
Dundee Sheriff Court heard Henderson, of Perth Prison, sneaked in through an open window while the property was unoccupied and made off with an Amazon Echo Dot.
When he was caught on the stairwell, he claimed he only wanted to hand Christmas presents to his son.
He had been previously barred from entering the street or attempting to contact his former partner for a period of two years.
The court order was handed down after he was convicted of a spate of domestic violence offences against her.
Depute fiscal Marie Irvine said the woman returned home to find mud on the window ledge.
The witness said it was “clear” someone had accessed the property and when the child opened the front door, Henderson was standing on the stairway, asking to come in.
A defence agent acting on behalf of Henderson said he had “struggled to cope” with the concept of the order.
The court heard he has 54 previous convictions including violence, drugs and domestic assault.
Sheriff Lorna Drummond said it was clear Henderson was unable to comply with court orders.
She jailed him for 16 months, backdated to January 13.
