The case against Angus holiday park bosses accused of a four-year catalogue of failings that led to the tragic drowning death of a Dundee youngster has been deserted.
Six-year-old Aidan Caleb Yule was found in an Arbroath pool in 2011 and was rushed to Ninewells Hospital, only to die four days later.
The operators of the Red Lion Caravan Park appeared on a health and safety indictment over the park’s failings at Forfar Sheriff Court.
Loch Earn Caravan Parks, of Errol, are accused of a number of failures over a four-year period leading up to Aidan’s accident on June 18.
The firm was accused of failing to make a suitable and sufficient assessment of the risks to members of the public when using the swimming pool, failing to ensure adequate supervision at the poolside, and failing to provide sufficient training to employees over the safe use of the pool between July 1 2007 and Aidan’s accident.
As a consequence the non-swimmer, also known as Aidan Sands, became submerged and sustained injuries, from which he died.
However Sheriff Pino Di Emidio allowed a Crown motion to desert the case, after it emerged he knew one of the company’s directors.
The Crown will re-raise proceedings in July.
