A banned Brechin driver rode and crashed a motorcycle into the path of a car after his throttle got stuck.
Leon Eccles, of Wards Road, admitted that on October 22 at Cookston Road, Brechin, he rode the motorcycle without due care and attention at speed and failed to give way and he collided with a car, causing damage to both vehicles.
The 21-year-old also admitted riding the bike without protective head gear, without insurance and while disqualified.
Depute fiscal Kirsten Letford told Forfar Sheriff Court: “The accused was disqualified until January 2021.
“A witness was driving an Audi A3 southbound on Cookston Road in Brechin when he noticed the motorcycle being driven on the footpath.
“The accused then moved the motorcycle from the path at speed onto the road and failed to give way right into the path of the car. The vehicles collided.
“A passer-by checked that the accused was ok. Eccles said that the throttle was stuck on the motorcycle.
“He stated to the car driver that he didn’t have insurance and offered to pay for the damage. However, the car driver called the police.”
The accident caused Eccles to sustain some cuts and caused a rip to his jeans.
Defence agent Lynne Sturrock said that initially her client was driving the motorcycle on farmland when he lost control.
She said: “He remained at the scene of the crime which in the past he hasn’t done. He appears to be more mature in attitude.
“He would welcome the opportunity to co-operate with a high tariff structured deferred sentence.”
Sheriff Gregor Murray said he would consider an alternative to a prison sentence due to limits on sentencing.
He said: “Here’s the difficulty I face. The only charge that I can jail you on is driving while disqualified and the maximum sentence for that is six months.
“If I were to jail you, you would be out in as little as a month which doesn’t do anyone any good, least of all you.
“With hesitation, I will defer sentence on a high tariff basis for four weeks in the first place.”
The case will call again on December 22.
