A 60-year-old who subjected a woman to a terrifying sexual assault while helping her move home in Dundee, has been jailed.
Kenneth Grubb, of Prieston Road, attacked the 23-year-old mother-of-two in December 2018 after lending her boxes sourced through his work as a delivery driver.
After Grubb arrived at her new home to collect them, the victim walked past him and he placed both his hands underneath her clothing and squeezed her breasts.
Amid “repeated protestations”, he continued by placing his hands down her jeans and repeatedly touching her.
She had told Grubb “no, it’s wrong”, and described his attack as “coming totally out of nothing”.
Afterwards, she made hysterical phone calls to her friend and then her former partner, who rushed round and found her crying and curled up on a bed.
Police were then notified who arrested Grubb at his workplace at UPS.
Swabs were taken from his fingers which contained traces of the woman’s DNA.
In questioning by police, he claimed he had “misread” the situation and initially claimed she had consented.
On the day the trial was due to commence however, Grubb admitted to sexually assaulting the woman on December 19 2018.
Before being sentenced at Dundee Sheriff Court on Tuesday, his solicitor said although his client had tried to minimise his actions, he had acknowledged he acted for his own sexual gratification.
He said a “robust community-based disposal” may be an alternative to custody.
He added: “Although he is at moderate risk of re-offending, if his behaviour was addressed that would go some way to dealing with this.”
Sheriff Alistair Carmichael however, described it as an “abhorrent” crime that deserves a prison term.
He said: “This was a serious penetrative and prolonged sexual assault.
“It was determined and one that involved a degree of force in repeated protestations that she did not want it to happen.
“In my view, this offence is so serious that it requires a sentence that meets the need for punishment and society’s disapproval. There’s no alternative other than custody.”
He sentenced him to 13 months in prison, reduced from 15 months because of his guilty plea.
He was also placed on the sex offender’s register for 10 years.
