A first-time domestic offender who admitted to grabbing his partner by the throat and repeatedly spitting on her head has been spared jail.
Stephen Higgins, 34, pled guilty to chasing the woman into the bathroom, spitting on her head, and repeatedly seizing her neck at Blaikies Mews in Dundee, where he lives, on November 3.
Acknowledging Higgins is still in a relationship with the woman, Sheriff John Rafferty handed him a community payback order with 12 months of supervision at Dundee Sheriff Court yesterday.
However, he warned Higgins he was lucky to avoid a custodial sentence, adding: “If any similar offence occurs again you are very likely to face jail.”
