A man made crude comments to a woman’s five-month-old baby before sneaking into her house in the middle of the night to sexually assault her as she slept.
James Du-Tracy made a pass at his victim hours before the attack when she offered him a beer in return for work he had carried out in her garden, but was rebuffed.
He walked out of her home and went to a nearby pub while the woman fell asleep on her sofa with her child asleep in its pram beside her.
She awoke at 1.10am to the sound of her child crying then realised Du-Tracy had sneaked into her house and begun a sex attack on her.
Depute fiscal Vicki Bell told Dundee Sheriff Court that the victim found the accused had lifted up her top, her trouser buttons had been undone and the accused was lying on top of her.
“She pushed him off and he fell on to the floor. The accused said nothing,” the fiscal added.
“He kept saying ‘accept my apology, I know how serious this is’.
The accused then contacted her by private message on Facebook a few days later and asked to meet and discuss what had happened.
A week later, Du-Tracy, 29, of Duncan Road, Letham, handed himself in to police and he pleaded guilty on indictment to a charge of sexual assault committed on June 13 last year at an address in Angus.
Defence solicitor Ian Flynn said Du-Tracy had shown “extreme remorse” since the offence.
The accused was remanded in custody for the preparation of reports and his name added to the sex offenders register.
