Fife man on Sex Offenders Register after ‘disgusting’ offences against teenager

Kirkcaldy Sheriff Court

A Fife man had sex with an underage girl he met online and repeatedly ordered her to harm herself during video calls.

Adam Smith, 22, also made threats to harm the girl’s toddler sibling to force her to comply.

Smith had “consensual” sex with the teenager, who was just 15 and cannot be named for legal reasons, on multiple occasions.

Kirkcaldy Sheriff Court heard the youngster’s mother repeatedly overheard her daughter crying out as Smith encouraged her to punch herself.

A text exchange read out by depute fiscal Mat Piskorz revealed he had threatened to slit the throat of her sibling.

Smith also repeatedly demanded money from the girl.

Pair met online during lockdown

Mr Piskorz told the court the teenager had been involved in a relationship with Smith.

He said: “She began communicating with the accused online during lockdown restrictions in March 2020 and only met the accused face-to-face in June 2020.

“The complainer was 15 at the time and the accused was 20.

“In June 13, 2020 the complainer arranged to meet the accused at his home, where they engaged in sexual intercourse.”

Smith later sent the girl’s mother a number of images of her daughter in sexually suggestive poses, along with a 10-second video clip of her carrying out a sex act.

He said Smith quickly became abusive, insulting the girl, telling her what to wear and demanding money.

This resulted in a change of demeanour that was noted by teachers, as well as the girl’s mother.

Threats to younger child

One another occasion the girl’s mother was woken by “screaming” coming from the her daughter’s room and found her “on a Whatsapp face call with her other hand clenched”.

However, the girl denied she had been punching herself.

On other occasions she heard Smith telling the girl to get a knife while she was on phone calls with him and his threats to harm her younger child.

When interviewed by police, Smith admitted having sex with the girl on three occasions but claimed he had waited until she was 16.

However, a forensic examination of his phone revealed numerous messages in which she repeatedly stated she was 15.

‘Disgusting offences’

Solicitor Chris Sneddon, defending, said the sex between the pair was “very much consensual” and the teenager had had previous sexual partners.

However, he said Smith acknowledged he should have waited until the girl turned 16 and expressed remorse for his actions.

Smith, a prisoner at Perth, admitted engaging in a course of conduct which was abusive of his ex-partner at an address in Glenrothes between 2020 and January.

He further admitted having sex with the underage teenager on various occasions last year.

Branding Smith’s actions “disgusting offences”, Sheriff Elizabeth McFarlane jailed him for 28 months and placed him on the Sex Offenders Register for 10 years.

He will be supervised for 12 months after release and is banned from contacting the teenager for five years.
