A police officer injured in the incident which claimed the life of Kirkcaldy father Sheku Bayoh will stand trial later this year.
PC Nicole Short, 30, is accused of illegally accessing computer data in a case unrelated to Mr Bayoh’s death in May 2015.
There was a question mark over her fitness to attend court.
However at Kirkcaldy Sheriff Court on Thursday solicitor Christine Hagan said a doctor had now deemed Short fit to stand trial.
Short has been ordained to appear for trial in October.
Short, of Glenrothes, denies three charges of viewing crime files of two people for non-policing reasons without consent and accessing the Scottish Intelligence Database to gain information about them on two dates in October 2012.
