Driver jailed for six years for double attempted murder in Perth

A crazed driver who tried to kill two men in Perth has been jailed for six years for double attempted murder.

Mark Wishart flew into a rage after someone aimed a kick at his Vauxhall Astra outside a nightclub on April 28, 2019.

The 36 year-old sent Kirk Fisken flying into the air and also hit Scott Peletier.

Jurors heard how both victims were lucky to suffer only minor injuries.

Lift engineer Wishart was sentenced at the High Court in Glasgow having been convicted after a trial in Dundee of attempting to murder both men.

His lawyer told judge Lord Summers the crimes had been “spontaneous rather than pre-meditated”.

The trial had been shown CCTV of Wishart doing handbrake turns and driving at high speed in the centre of Perth in the early hours of a Sunday morning.

A person was said to have lashed out at his car.

Mr Fisken – who had not been involved – was due to meet a friend outside The Loft nightclub when Wishart’s car mounted the pavement.

He told jurors: “I just became aware of this screeching noise and all I heard was my friend shouting my name.

“I could see a car coming straight towards us…and had come on to the pavement.

“I was then hit and went right up into the air, over the whole car and dropped over the back.”

Despite the horror, Mr Fisken was able to get up and walk away.

He said nothing was hurt “apart from his ego”.

Attempted murder ‘spontaneous offence’

Jurors were told Mr Peletier had been “clipped” by Wishart’s car, causing him to suffer a bruised hip.

No witnesses to the incident had been able to identify the driver.

However, Wishart, of Bridge of Earn, was arrested after driving away when initially pulled over by police.

Tony Lenehan, defending, said on Thursday: “This was a spontaneous offence rather than anything which involved pre-meditation.”

Sentencing, Lord Summers told Wishart: “Mr Fisken had nothing to do with the incident (involving the car being hit) and could have been killed by your reckless behaviour.”
