Monday court round-up — Woman bit police officer

Court round-up graphic

A woman who bit a police officer during a drunken fracas at her Perth home has been placed on curfew.

Kaya Stewart was found guilty of attacking two constables on December 28 2020.

Police were called to the 29-year-old’s home in Craigie Road following reports of a disturbance at a family gathering.

Stewart attacked PC Kathryn Knox by repeatedly punching her on the body.

She then assaulted PC Christopher McInnes by biting him on the body and striking him on the groin with her knee.

Stewart was convicted of a third charge of behaving in a threatening or abusive manner on a journey between Craigie Road and Dundee.

She repeatedly shouted, swore, adopted an aggressive demeanour and made violent threats towards police.

Solicitor David Holmes, defending, said alcohol had been taken.

Sheriff William Wood told Stewart: “I understand that you thought that this was a private matter but the police are there to protect everyone.

“This is a serious matter. It’s one that may well have attracted a period in prison.”

The sheriff imposed an 18 months supervision order and a restriction of liberty order for 12 weeks “as a direct alternative to custody.”

Fine for sharing private picture

A Fife painter and decorator has been fined for sending a picture of a woman in her bra to his friend, who then shared it online.

Cameron Oswald, 25, of Glebe Road in Cowdenbeath, pled guilty at Dunfermline Sheriff Court.

Senior procurator fiscal Azrah Yousaf told the court Oswald and the woman had met through Facebook and would often send photos – nude or wearing underwear – to each other.

The depute fiscal said on one occasion in 2019 the woman sent one of her upper body and a bra and she asked him not to share it after realising he’d taken a screenshot.

He told her he would not.

A friend of Mr Oswald’s later posted the image of the woman without her consent so she called the police.

Oswald was charged and told police at the time: “The image that was sent I did not think was classified as a nude, or I would not have sent it.”

Defence lawyer Zander Flett said it “was of course not a nude” and that his client was no longer in contact with the person who posted the image, or the woman.

Sheriff Grant McCulloch told Oswald: “Whatever the assumption is to share the image, that should not have happened.

“They were between two of you and to send them off to a pal was inappropriate.

“Hopefully you have learned a lesson – things are private so keep them private.”

The sheriff fined Oswald £300.

Former MP trial delayed

Former politician Natalie McGarry had her embezzlement trial postponed as she is unwell.

McGarry, 40, denies embezzling more than £25,000 from two Scottish independence organisations between April 2013 and August 2015.

McGarry allegedly embezzled £21,000 while Treasurer for Women for Independence (WFI) between April 26, 2013 and November 30, 2015.

The second charge states McGarry took £4,661 between April 9, 2014 and August 10, 2015 when she was Treasurer, Secretary and Convenor of Glasgow Regional Association of the SNP.

McGarry was not in the dock for the fifth day of the trial at Glasgow Sheriff Court, which is set to last six weeks.

The trial is slated to continue on Tuesday before sheriff Tom Hughes.

Bad break-up

Angus man Kevin Findlater pled guilty to two charges of dangerous driving, among other crimes connected to his break-up with his former partner and victim. In one incident, he swerved across the road in front of her car and another, causing both to take evasive action. In another, he followed her at Westmuir reserve, near Kirriemuir.

Old Firm bottle charge

A man has appeared in court charged with throwing a bottle at a Celtic physio at the Old Firm game.

Alan Crawford, 32, of Grangemouth, Falkirk, allegedly assaulted Daniel Friel at Ibrox Stadium on April 3 2022.

Court papers state Crawford threw a bottle towards Mr Friel causing it to strike his head.

The charge claims this was done to Mr Friel’s severe injury and permanent disfigurement.

Crawford made no plea at a private hearing at Glasgow Sheriff Court.

He was granted bail by Sheriff Iain Fleming.
