Friday court round-up — Wetherspoons assault and hole in the road

Motorcyclist Andrew Irvine, 36, from Buckhaven has been banned from the road after admitting driving carelessly and dangerously on August 7.

His journey took him from Den Street in Buckhaven to Institution Street near Denbeath Primary School, Wall Street and elsewhere in the town.

Uninsured Irvine, of Bow Street, also admitted riding a moped dangerously through Windygates at excessive speed on September 18 and failing to stop at a red light.

He also drove at PC Jamie Soutar, causing the officer to take evasive action in order to avoid being struck.

His  journey came to an end when he ploughed through a plastic roadworks barrier and entered a hole in the road.

Irvine came off his moped and injured himself.

Sheriff Craig McSherry deferred sentence until June 8 and banned Irvine from the road.

AWOL sex criminal

A dangerous sex criminal who vanished from his home in England was found secretly working as a night porter at a top Perthshire wedding venue. Brandon Foskett had travelled from Northumberland without telling police. He was given a prison sentence.

Wetherspoons assault

A teenager from Dalgety Bay has been spared imprisonment after attacking her unconscious partner in a Fife Wetherspoons.

Frances Johnston previously admitted assaulting the woman at Dunfermline’s Wetherspoons pub on the town’s High Street.

On September 20 2020, she grabbed the woman by the hair, pulled her to the ground and kicked her on the head.

While her victim was unconscious, Johnston repeatedly punched her on the head and body.

Johnstone, 19, also pled guilty to racially abusing a police officer who attended, shouting, swearing and uttering offensive comments at him.

Bistro worker Johnston appeared at Kirkcaldy Sheriff Court to be sentenced.

Sheriff Craig McSherry ordered her to complete 200 hours unpaid work in the next year as a direct alternative to custody.

Dog fighting trainer

Angus gamekeeper Rhys Davies, who trained dogs to fight badgers and foxes, exposed a ring of wildlife criminals when he sent “trophy” photographs to be printed. The Scottish SPCA and police raided the his home near Glenesk and found severely injured dogs and unsecured firearms.

Rhys Davies will return to Forfar Sheriff Court for sentencing.

Delivery driver banned

A delivery driver with 12 penalty points on his licence has been banned from the roads after failing to properly insure his car.

Fehmi Dzuvalekov was found to have Just Eat delivery bags in his car when he was stopped by police for having a broken brake light.

Subsequent checks found that the vehicle – a Nissan Almera – was not insured.

Dzuvalekov, who represented himself, admitted driving without insurance and with a broken brake light at Kirkcaldy’s St Clair Street on January 15 this year.

The 31-year-old, of Mill Street Kirkcaldy, told the town’s sheriff court he had recently bought the vehicle but had forgotten to transfer his business insurance from a previous vehicle – a Honda Civic.

Sheriff Timothy Niven-Smith handed Dzuvalekov six penalty points.

Due to the 12 live points already on his licence, Dzuvalekov was disqualified from driving for six months under the totting-up procedure.

He was also fined £300.

Assaulted ‘murder’ victim

A Perth man who brutally assaulted suspected murder victim Ian Menzies 18 months before his death has been ordered to pay compensation to his family. Darryn Calder, who has a history of violent behaviour, randomly attacked Mr Menzies at the city centre Sandeman bar nearly three years ago.

Heavy breather

A Fife man bombarded his ex-partner with abusive calls and texts, breathed heavily down the phone to her and sent an email to her employers containing a false allegation about her.

Andrew Reilly, 39, of Kirkburn Drive in Cardenden, pled guilty to engaging in the course of abusive behaviour towards the woman, which also involved repeatedly shouting, swearing and threatening her by phone, between March 28 and April 14 this year.

Court papers state the offending took place at various addresses in the Lochgelly and Kirkcaldy areas.

Sheriff Alison Michie deferred sentencing until June 1 for background reports and remanded Reilly in custody in light of the nature of the offence and his previous record.

The court heard Reilly has been in custody since April 16.
