A 27-year-old man who had sex with a 15-year-old girl in the grounds of a Fife school has been jailed and placed on the Sex Offenders Register for life.
Jordan Hamilton engaged in sexual activity with the underage girl outside the school in July last year, despite her telling him she wanted to wait until she was 16.
Procurator fiscal depute Claire Bremner told Kirkcaldy Sheriff Court Hamilton joined a group teenagers who had been drinking in Dunfermline and he bought them more alcohol before they went to a golf course.
He had earlier met someone in the street who was on their way to meet the group.
Hamilton became flirtatious with a girl there and during the evening they kissed and held hands and she told him she was 15.
The group then went to a bike shed area in the grounds of the school and Hamilton took his top off and lay down close to the girl.
The fiscal depute said: “At this time the complainer could hardly walk due to her level of intoxication and asked the accused to carry her and he lifted her up.”
Pushed girl onto bench
Ms Bremner said Hamilton then repeatedly tried to sit next to the girl on a bench but she moved away from him, telling a friend she did not want to do anything with him until she was of legal age.
The court heard the pair continued to flirt and he put his arms around her and they kissed.
Hamilton then approached the girl from behind and kissed her on the neck, giving her a love bite, before pushing her onto a bench and pulling down her clothing and having sex with her.
The fiscal depute said the girl stopped and said she wanted to wait until she was 16 and Hamilton stopped and they kissed again.
A friend who witnessed this felt uncomfortable and went home and reported what happened to others who contacted police.
Hamilton pled guilty in April to engaging in sexual activity with a girl under the age of 16 by putting his arms around her, kissing her and biting and sucking her neck, pulling down her clothing and having sex with her in the Fife school’s grounds.
He appeared in court this week for sentencing.
Jailed
Sheriff James Williamson jailed him for two years, backdated to July 29 last year when he was remanded in custody for the offence.
The sheriff also placed Hamilton, a prisoner in Perth Prison, on the Sex Offenders Register for life.
The court heard he was already on the Register in relation to a previous conviction.
Defence lawyer Chris Sneddon said Hamilton fully accepts responsibility for his actions and stressed this was not a case of him going out and targeting young people.
The solicitor also confirmed to the sheriff there was no issue with consent in terms of the charge.
