A man who poured water over a woman and called her a slut after the pair were at an 18th birthday party has avoided being sent to jail.
Perth Sheriff Court heard that Alan Gibb, 36, of May Place, Perth, had been in a relationship with the woman for two years.
“The couple were at an 18th birthday party and had been drinking alcohol,” depute fiscal Carol Whyte said.
“The couple were walking home just after midnight but were arguing.
“Once in the property, the accused picked up a bottle of water and poured its contents over the woman.
“He also kicked a portable electric heater, breaking its plastic case.”
The court was told Gibb was shouting and swearing at the female, and called her a “slut.”
Solicitor David Sinclair, defending, said the woman has stated she wishes to remain in a relationship with his client, but admitted Gibb had been having problems with his estranged wife at the time of the offence. This manifested itself at this time.”
Gibb pled guilty to a charge that on April 24 at an address in Bridge Lane Park, Perth, he poured a bottle of water on to a woman’s face.
Sentencing Gibb, Sheriff William Wood told him: “This is your fourth conviction for domestic assault and this shows a significant escalation of this behaviour.
“However, I’ll go along with the background report which recommended an alternative to jail, which is a community programme order.”
He ordered Gibb to carry out 135 hours’ unpaid work in the community.
