Tuesday court round-up — Fifer raped sleeping woman

A rapist who carried out a sex attack on a sleeping woman in Fife has been jailed.

Dwain Morgan had denied raping the woman at a house in Kelty on September 19 or 20 2019 but was found guilty of the offence by a majority verdict at the High Court in Edinburgh.

The woman told the court she had gone to sleep but woke up to find Morgan, 31, raping her.

She said: “I was raging beyond words.

“I was incredibly upset and drunk.”

The woman denied having consensual sex with Morgan and said: “I was fast asleep.”

Morgan, of Erskine Wynd, Oakley, was convicted of assaulting and raping the woman while she was intoxicated and incapable of giving or withholding consent.

Lady Scott remanded him in custody and deferred sentence until next month for the preparation reports.

He was placed on the Sex Offenders Register.

Funeral fraudster

Fife funeral firm CEO Barry Stevenson-Hamilton admitted swindling customers by selling non-existent end-of-life plans.

The 39-year-old, who had outlets of Stevenson Funeral Directors across Fife, admitted gaining more than £130,000 by fraud.

He was locked up pending sentencing.

Perth drug dealer

A 39-year-old man was caught with heroin and Oxycodone at his home in Perth.

Andrew Townsley admitted possession of the class A substances on November 3, 2020, at his Ross Avenue flat.

Sheriff Francis Gill ordered background reports and told Townsley to return to court for sentencing on August 24.

The crown accepted not guilty pleas to similar charges from co-accused Chloe Hamilton.

Hit-and-run

A hit-and-run pensioner ran down a Perth schoolboy and left him injured at the roadside so she could play golf. Muriel McPherson, 76, saw the 13-year-old bounce off the bonnet of her car and land on the street in front of her. Firefighters stopped to treat the youngster as McPherson left the scene to get to Blairgowrie Golf Club.

Hammer time

Dundee man Kyle Stewart, 24, has been given unpaid work after admitting having a hammer during a fight.

He admitted being in a public place with an offensive weapon and conducting himself in a disorderly manner in August last year on Ballumbie Drive.

Kyle Stewart appeared at Dundee Sheriff Court.

Depute fiscal Calum Brown told the court: “At around 3.30pm on August 30, witnesses observed Stewart in possession of a hammer.

“Police were called, they also observed the accused in possession of a hammer.

“There was blood on the accused.”

Defence solicitor Mark Waters, in mitigation, said: “The other male attended his home, an argument ensued and he acted… in a way he is embarrassed about.

“It is not a way he acts regularly.”

Stewart was ordered to carry-out 85 hours of unpaid work.

Blackmail sex plot

Blackmailer Kevin Proctor from Monifieth targeted vulnerable victims in an elaborate sex plot. Victims were lured into the callous scheme after being randomly sent photographs of a young woman with a claim she needed help. He was caught because his DNA was discovered on a handwritten ransom demand.

Glenrothes drink-driver

A Glenrothes drink-driver has been banned from the road after police pulled him over for poor driving.

Alan Paterson appeared at Kirkcaldy Sheriff Court to admit driving with 222 milligrammes of alcohol per 100ml in his urine, well above the limit of 67 milligrammes.

Police followed his green Peugeot on March 14 last year and were concerned by his driving so pulled him over on Warout Road.

Unemployed Paterson, of the town’s Huntly Drive, was fined £395 by Sheriff Elizabeth McFarlane.

His solicitor Danielle Stringer said: “He had been drinking at his property.

“He fully accepts that it was irresponsible of him to do so.”

The sheriff also banned him from driving for a year.

“It could potentially have been more, given the very high reading,” she told him.

‘Maternal instinct’

A Fife mum-of-eight attacked a man and told him to stay away from her children because he was a “paedo”. Hayley Ross carried out the “unprovoked” assault in Cardenden, claiming her “maternal instinct” had kicked in.
