A Fife forklift driver sent his former partner an intimate photo of herself in a “frightening” revenge porn attack.
Krzysztof Sokolka told his victim she would not want the explicit picture to be “in space”.
Aided in the dock by a Polish interpreter, Sokolka admitted disclosing the intimate image, which showed the woman naked on a bed, alongside the ominous message.
The 53-year-old, of Pottery Street in Kirkcaldy, admitted that on June 2, he sent the woman a threat to disclose intimate images to family, attaching the picture as part of the threat.
He sent the image from a property in Glenrothes’ Victoria Path.
Prison warning
Sheriff Timothy Niven-Smith handed him a non-harassment order lasting two years and 160 hours of unpaid work.
He warned Sokolka, as the sentence was a direct alternative to jail, if the work is not completed within a year, he will be imprisoned.
The sheriff said: “You previously pled guilty to an offence which is usually described in the media as an offence of revenge porn.
“Your relationship having broken down, you sent a message to your former partner which attached to it was an intimate picture.
“As an adult of normal intelligence, you must understand that your actions would have caused fear or alarm to your ex-partner, particularly if the image had got into the public domain.
“Your actions were clearly calculated and designed to get back at your ex-partner for finishing your relationship and the court views your conduct seriously.”
First offender
The sheriff said due to the presumption against short sentences and Sokolka’s age and working background, there was an alternative available to a jail term.
“In your case, you have no previous convictions of any relevance and I’m persuaded to deal with you as if you were truly a first offender.
“You have saved your ex-partner the ordeal of coming to court to give evidence about a matter of this delicate nature.”
Sokolka admitted the domestically aggravated offence in June at Kirkcaldy Sheriff Court.
