A Perth sex offender who attacked a woman while she slept has been jailed and will be monitored after his release.
Fahad Mateen, 29, was convicted by jurors of performing a sex act on the woman at a property in the city’s Tulloch area.
Before being jailed, he was told by a sheriff his actions were “one of the most appalling of violations a man can undertake to a woman”.
Sheriff William Wood jailed him for two years and imposed an extended sentence which will see him on licence for the same period again after he is liberated.
He was found guilty of committing the October 15 2019 sexual assault after a trial at Perth Sheriff Court.
The sheriff also lambasted Mateen, of County Place, for forcing his victim to give evidence when his DNA had been traced in his victim.
Sheriff blasts accused for trial
Sheriff Wood told the first offender: “I take quite a dim view the complainer was put through this experience of giving evidence. That was avoidable.
“The scientific evidence is hard, if not impossible, to rebut.
“I’m of the view only a significant custodial sentence will be appropriate.
“The complainer was placed in a very difficult set of circumstances.
“Although I’m prepared to accept there may have been some intimacy, the complainer explained in graphic detail she was not (able) to have consented to what happened.
“I’m aware that she has suffered significantly psychologically as a result of this attack.
“It is one of the most appalling of violations a man can undertake to a woman.
“I do have some concerns that on your release you are adequately equipped for forming relationships.
“It is to be hoped that it will change your perspective about what is acceptable and what’s not acceptable when you’re released from custody.”
‘Ashamed and embarrassed’
Defending lawyer Paul Mullen said: “Despite being found guilty by the jury, I’m instructed to say on behalf of Mr Mateen that he feels ashamed and embarrassed by his actions.
“That is something that is borne in the criminal justice social work report.
“This episode has impacted on him greatly but in fairness to him, that will have impacted negatively to a very great extent to the complainer.
“Notwithstanding the serious allegations which he was convicted of, it is a matter which could be marked by the imposition of a community payback order.
“He is deemed not to be a high risk offender.”
When Sheriff Wood explained only custody was being considered, Mr Mullen explained Mateen would welcome the engagement post-release that comes with an extended sentence.
Mateen was placed on the Sex Offenders Register for a decade and handed a non-harassment order which will ban him from contacting his victim also for ten years.
