A spurned mistress who posted “revenge porn” pictures to her secret lover’s wife has been ordered to carry out 100 hours of unpaid community work.
Beauty therapist Agne Balciene had an affair with a married man and sent graphic pictures of her illicit lover to his wife on her birthday.
Balciene, 38, then posted the images of her secret lover on social media sites after the break-up of their two-year long relationship.
However, she was not placed on the Sex Offenders Register.
Sheriff George Way said: “It is very clear what happened and I think it is a slip that Ms Balciene will not make again.
“However, the nature of the offences and their impact – which she perhaps minimises – mean that for denunciation and deterrence, there has to be some unpaid work.
“I am satisfied that the purpose of this crime was revenge and hurtfulness etcetera and that there was no sexual element significant enough to require registration.”
Facebook shock
Dundee Sheriff Court was told Balciene had taken umbrage after discovering her lengthy affair was being denied by her lover’s wife.
Fiscal depute Christine Allen told the court the accused and her 38-year-old lover had both been married to other people when they met.
She said the relationship continued for around two years before it eventually came to an end around the start of 2020.
The award-winning beauty therapist had heard his wife had been denying rumours of the affair within her local community in Dundee.
When the wife received a number of Facebook messages to wish her a happy birthday in August 2020, Balciene decided to reveal the truth to her.
Mrs Allan said: “She received a private message from the accused at around 2 am which stated ‘Happy Birthday’ and had photographs attached.
“The accused then went on to post them publicly on Facebook.”
‘Moment of madness’
The 38-year-old was sent a picture of her husband wearing boxer shorts, tied to a staircase bannister and a second one of him showering.
Solicitor John Boyle, defending, said: “It was a moment of madness, contributed to by the fact she had had a quantity of alcohol.”
The post was reported to police and Balciene, Lismore Terrace, Dundee, admitted posting revenge porn to her love rival at her address in Dundee on August 16 2020.
She admitted threatening to post – and then posting – intimate photographs of the man without his consent, to his wife, and publicly.
She admitted threatening to post more graphic images to cause fear, alarm or distress.
Sheriff Way said: “There’s a lot of public disquiet about this type of behaviour so it is not capable of being dealt with only by a fine.”
He confiscated the accused’s mobile phone.
