Friday court round-up — Assault, shouting and stealing

A drunken Scone woman who attacked two police officers has been ordered to carry out unpaid work.

Perth Sheriff Court heard officers tried to escort Leanne Kerr to her home in Affric Avenue after she was asked to leave a friend’s house on July 3.

The 31-year-old flew into a rage and attacked PC Kerri Milne by punching her on the body and kicking her on the head.

She also kicked PC George Lauder on the body.

Solicitor Pauline Cullerton said her client was not a big drinker and did not go out socialising often.

Sheriff James MacDonald told Kerr: “These are two serious matters. It was a course of conduct.”

Kerr was placed on supervision for a year and told to carry out 120 hours of unpaid work.

Killer Dundee dog

The dog which killed Angus kennels owner Adam Watts is the same one which savaged a woman and two smaller dogs in Dundee in earlier attacks, it has emerged.

The American Bully XL was removed from Peter Fyfe after it went out of control in separate incidents in the city, attacking a woman and her small dog and ragdolling another pet.

Fyfe, 48, was this week banned from keeping dogs for five years, a term one of the victims said was insufficient.

Mr Watts died when the dog attacked him at the kennels in Auchterhouse soon after it was taken away from Fyfe.

It was subsequently destroyed.

Peter Fyfe’s out-of-control dog later killed Adam Watts (right) at his Auchterhouse kennels.

Sexual assault

A 43-year-old man has admitted sexually assaulting a teenager as she slept on a sofa at a property in Fife.

Paul Jankowski fondled and kissed the 16-year-old girl’s breasts and placed his hand inside her underwear and sexually touched her.

He admitted doing this while his victim was asleep and incapable of consenting.

Dunfermline Sheriff Court heard the incident took place at a property in High Valleyfield in August last year.

Procurator fiscal depute Laura McManus said the girl was lying on a sofa with her feet up watching TV when Jankowski began to rub her feet and legs.

The fiscal said: “The complainer thought this was strange but drifted off to sleep.”

Ms McManus said the girl woke to find Jankowski lying awkwardly on his side beside her and she became aware he was touching her.

The fiscal depute continued: “As the complainer woke she realised and slapped his hand away”.

Ms McManus said the girl later became “uncontrollably upset” about the incident.

The court heard that Jankowski, of Shawpark Avenue in Sauchie, had been drinking alcohol prior to the offence, which took place in the early hours of the morning.

Sheriff Susan Duff adjourned sentencing until December 8 for the production of background reports.

Tea scam charges

Tea plantation boss Thomas Robinson, 52, from Amulree, appeared in court to deny of scamming some of Britain’s best known names, the Balmoral, the Dorchester and Fortnum and Mason as part of a near-£600,000 fake Scottish tea plot. Thomas Robinson faces allegations he set up a fraudulent scheme to dupe firms into buying tea he claimed was grown at his plantation in Highland Perthshire but was actually bought from wholesalers.

Shouting and stealing

A Perth woman who shouted at pals in a High Street store and stole false eyelashes worth £3.99 has been fined £450.

Khaya Ghekis appeared at Perth Sheriff Court and admitted stealing from Savers in Perth High Street on January 26, 2021.

The 35-year-old, from Rutherford Court, also admitted behaving in a threatening or abusive manner at Boots on December 4 2020.

Fiscal depute Sarah Wilkinson said the stolen eyelashes were not recovered.

“The accused was in Boots with two associates.

“She was brought to the attention of workers as she was being very loud and shouting at her friends.

“She was asked to keep the noise down.”

Ms Wilkinson added: “That appears to be the extent of it.”

Solicitor Linda Clark said Ghekis had been impacted by lockdown.

Sheriff James MacDonald said: “These are relatively minor matters.”

He fined Ghekis £270 for the incident in Boots and £180 for the theft charge.

Prison alternatives

A judge is considering a non-custodial sentence for Fife van driver David McGregor, who killed a cyclist in an early morning smash on the A913 Cupar to Newburgh road in September 2019. He was found guilty of causing death by careless driving and was due to be sentenced but Lady Wade adjourned the case further to fully assess alternatives to prison.
