A former supermarket manager who molested a woman while she slept has narrowly avoided a prison sentence.
Stuart Thomson, 43, sexually assaulted a woman at an address on Marine Parade Walk in December 2019.
Thomson, a first time sex offender, was told there was a direct alternative to custody when he appeared for sentencing at Dundee Sheriff Court.
He pled guilty on indictment to sexually assaulting a woman on December 11 2019 by touching her private parts under her clothing, while she slept.
Sentencing had been deferred for reports.
Alternative available
Defence solicitor Jim Laverty, in mitigation for Thomson, said: “The report is full in its terms and my submission is a direct alternative to custody is possible.
“It recommends he could be made subject to a community payback order and there is a suggestion for electronic monitoring.”
Thomson, of Marine Parade Walk, will have to complete 260 hours unpaid work and register as a sex offender for two years, as well as taking part in supervision requirements required by the court.
Thomson’s LinkedIn page states he is a former Madras College student who was a manager with Morrisons from 1996 to 2019.
Sheriff’s reasoning
Sheriff Gregor Murray said: “In sentencing I must balance a number of factors.
“In your case a significant sexual assault occurred.
“I have to take into account the fact you are a first offender.
“You pose a low risk of reoffending (according to the report) and the offence took place some time ago.
“The author of the social work report is satisfied there are no programme requirements needed.
“I am prepared to offer you an opportunity to take part in a community payback order for two years.
“You will also be subject to the notification requirements of the sexual offences act for the duration of that period.”
