A driver must compensate the older man he “struck” in a Perth road rage attack.

David Gardiner admitted acting threateningly towards the man, before assaulting him on Burghmuir Road on October 5 in 2019.

Gardiner, of Leadenflower Road in Crieff , left his car and approached his victim’s vehicle.

He began shouting and swearing at the 65-year-old, before striking him on the head while he was still in the car.

Perth Sheriff Court heard Gardiner, 29, runs a dog-walking business.

Sheriff William Gilchrist fined him £600 and ordered him to pay the other man £250 in compensation.

Denies party threesome assault charges

Jean Esingle from Dundee has gone on trial accused of sexually assaulting two women and assaulting a male as he tried to get “involved” in their threesome at a Halloween party. Esingle denies the charges and the trial continues.

Used dead man’s insurance

Septuagenarian takeaway driver William Murdoch has been fined after using his dead business partner’s car insurance policy.

The 70-year-old of Abbey Park Avenue, St Andrews admitted driving without insurance on Bonnygate, Cupar on May 17 last year.

Dundee Sheriff Court heard he was employed as a delivery driver for Dino’s Pizza in Cupar when police arrived there.

Depute fiscal Larissa Milligan told the court: “The accused was spoken to and it was ascertained he was a delivery driver.

“He used a blue Mazda Six in the course of his employment.

“Checks showed it belonged to another gentleman who was singularly insured on the vehicle.”

Defence solicitor Billy Watt, in mitigation for Murdoch, said: “In this instance he had been engaged by the takeaway as a delivery driver.

“The vast majority of his deliveries were done on foot.

“The car was insured to his old business partner.

“The car has been passed to a family member.”

Sheriff Paul Brown endorsed Murdoch’s licence with six points and fined him £270.

Testing times for officers

A teenage girl booted two police officers in the testicles after they turned up to disperse a group of drinking youths. Gracie Mills, 18, was drunk when she lashed out, leaving the officers in severe pain.

Lorry driver ban

A Perth lorry driver has been disqualified after refusing to complete a breathalyser test.

Garry Foley, 38, of Bute Drive, pled guilty to failing to provide a breath sample on April 3 last year.

At Perth Sheriff Court, fiscal depute David Currie said police had been alerted about a car being driven erratically between Coupar Angus and Blairgowrie.

Officers traced the car and found open alcohol containers inside and went to registered keeper Foley’s former address in Queen Street, Coupar Angus.

He matched a description provided and police believed he was drunk but he refused to provide the sample.

Solicitor Paul Ralph said Foley drives HGVs between 75,000 and 100,000 miles a year around Scotland.

Sheriff Grant McCulloch fined him £370 and disqualified him for 18 months.

The sheriff said: “I find it difficult to understand the stupidity when a person in your position behaves in this way.”

Shopkeeper touched schoolgirl

The boss of A&A Stores in Anstruther sexually assaulted a 15-year-old customer in direct view of two of her friends and his own CCTV. Rajiv Sharma touched the youngster as they passed each other in an aisle. He was found guilty after trial.

Didn’t know he was disqualified

A Whitfield driver did not know he was disqualified when he was caught behind the wheel on a Kinross-shire stretch of motorway.

Police challenged Darren Towns on January 3 this year after spotting his Audi RS3 on the M90 near junction six at Kinross.

They challenged Towns, who had been banned until June after a hearing at Merseyside Magistrates Court.

However, Towns’ solicitor said because he had not attended that hearing, his client did not know he was disqualified.

But on May 7 this year, Towns’ caught the attention of the law again while driving on the M90.

On the 70mph road, he reached 109mph near Fruix.

Sheriff William Wood ordered Towns, of Finella Terrace in Dundee, to complete 180 hours of unpaid work and banned him for two years.

He said: “Mr Towns, you’re 33 now and its about time you started to take responsibility.

“Driving while disqualified is a serious offence.”

Groped teens

A St Andrews golf club worker sexually assaulted two young girls and then attacked the Good Samaritan who rushed to their rescue. Grant Mills targeted a group of youths gathered in a secluded area and groped two youngsters after downing a bottle and a half of Buckfast.
