A man has told a court he feared he might “die” as was attacked during an alleged sexual assault.
The male accused Jean Esingle, 32, of seizing him by the throat after the accused allegedly sexually assaulted two women at a party.
Esingle is alleged to have sexually assaulted the women over the evening of October 31 2021 at an address in the city.
The three complainers had been engaged in a consensual sexual act when Ensingle entered.
Legal orders mean none of them can be identified.
Tried to get ‘involved’ in threesome
One woman gave evidence at Dundee Sheriff Court on Thursday and described how she, the male and the other woman were involved in an intimate and consensual act following a house party in the city.
She claimed Esingle entered the bedroom where all three were entangled “with the intention of becoming involved.”
The male complainer had said during his evidence Esingle had approached the women from behind “with his penis out”.
The female witness said: “I froze up. (The man) recognised I was distressed.
“Esingle was behind me. (The man) told him to stop and it wasn’t happening.
“Esingle then progressed to shouting and told (the man) he could ‘do what he wants’ and then he grabbed (the man) by the throat.”
When it was suggested during cross-examination Esingle was only in the room and touched one of the complainers to collect a jacket, the male complainer said: “With his penis out? No.”
‘I did think I was going to die’
The Crown asked what the man meant by his statement claiming he felt he would “die”.
He responded: “What happened that night was as close as I could imagine to what it would be like to be raped.
“I did think I was going to die that night.
“I’m lucky to have never experienced sexual assault, as I’m a male.”
Esingle, of Whitehall Crescent, Dundee, denies two charges of sexual assault against the two women and another of assaulting the man by squeezing his neck until he struggled to breathe.
The trial before Sheriff John Rafferty was adjourned until December 8.
