Drunken new year tumble led to Dundee domestic abuser’s harassment breach

A domestic abuser breached the conditions of a non-harassment order banning him from contacting his former partner when he took a drunken tumble outside her home.

Welder Kevin Spokes, 36, had been visiting his ex-partner’s neighbour for new year drinks when he “had a collision with the pavement” outside, Dundee Sheriff Court heard.

Appearing from custody, Spokes was told by his defence solicitor to show the bruises on his arms to prove the extent and impact of his January 2 fall.

He had been banned at an earlier date from contacting or approaching his former partner or going to her home on Inveresk Gardens.

Accused found on pavement

Depute fiscal Laura Farquhar told the court: “It was around 3:25pm when police received an anonymous call reporting a distress at the locus.

“Police attended and traced the accused outside.

“He was lying on the pavement, speaking with the witness.

“The accused appeared under the influence of alcohol.

“Police placed him under caution and arrest and he made no reply.

“He was taken to Dundee police headquarters and interviewed.”

‘I tell my clients to run away’

Defence solicitor Andrew Lyall, in mitigation for Spokes, said: “These are unusual circumstances.

“He had attended his friend’s house next door to the complainer.

“He had consumed a lot of alcohol.

“He decided to go home when he had a collision with the pavement outside her house.

“As a result of that, the witness came outside and he engaged her in conversation while recumbent.

“That was the extent of this.

“He is told, like I tell all my clients, that if you happen upon a person like that (the subject of a non-harassment order) that you run away.

“But he was on the floor.

“He spent two nights in custody for this.”

Sheriff John Rafferty fined Spokes, of Ballantrae Road, £143.

Instant Karma

In 2021, the same court heard how drunken Spokes received instant “Karma” when he attacked his then-girlfriend the day after her father’s funeral.

The habitual offender dragged her across a room in her home, punched her and threw a chair at her.

However, as Spokes tried to make his escape by bicycle, he fell off and split his head on the road.
