A Fife rapist missed an important meeting to help a judge decide how to deal with him because he went to the toilet, a court heard.
Allen Lothian, 23, was supposed to meet a social worker after being remanded for sex crimes last month.
The vital meeting was to help the judge decide how long he got behind bars but instead of attending, callous Lothian answered the call of nature, failed to meet the author and got nine years for his crimes.
The High Court in Edinburgh had heard how Lothian set up around 140 Facebook accounts to stalk one of his victims between October 2014 and June 2018.
Lothian, of Anstruther, sent his victim messages in which he threatened to tell other people about the sex acts in which he forced him to participate.
Sentenced despite lack of reports
Judge John Morris KC heard how the youngster felt he had no other option but to contact Lothian.
The predator had started abusing the boy in the East Neuk of Fife when he was a four- year-old in 2006.
The ordeal lasted another 12 years and the court heard how the youngster’s mental health has been badly affected.
Judge Morris ordered Lothian to be remanded in custody following proceedings last month and called for a background report to inform Wednesday’s sentencing.
Defence lawyer Michael Anderson KC confirmed no report had been prepared and said: “He was on the lavatory at the time.”
Despite such a situation generally leading to a further deferral, Mr Anderson told judge Morris his client wanted to be sentenced immediately.
He said: “His background is dreadful. I can say he’s had an appalling life.”
Judge Morris told Lothian, who observed proceedings via video link from prison, he would serve nine years in jail.
He said: “You pleaded guilty to a series of very serious sexual offences and the only sentence available to me in these circumstances is a custodial one.
“Your name will also be added to the Sex Offenders Register for an indefinite period.”
Abused two boys
Lothian pled guilty to rape and sexual assault charges involving the first complainer and another young boy.
He raped his first victim while holding a knife to him and threatening him.
He also forced the young boy to watch child abuse videos.
Prosecutor Martin Crawford told the court: “The accused would threaten to tell other people about the sexual assaults between them.
“He would also threaten to hurt himself or hurt the complainer.
“The accused would add the complainer to Facebook groups. He would message the complainer on a daily basis.
“The complainer felt that he had to visit the accused.
“During the period between October 5 2014 and June 30 2018, the accused stalked the complainer.
“The accused would repeatedly set up Facebook accounts – the complainer would in turn block the accounts.
“The complainer would continually block the accounts.
“The accused would persist. He set up around 140 Facebook accounts in various names to contact him.”
Mr Crawford told judge Morris the first victim is dealing with “flashbacks” and “nightmares” and is having to take medication.
The advocate depute added: “He is receiving psychiatric support and has trouble leaving home.”
Lothian sexually assaulted another 11-year-old boy on an occasion between September 1 2016 and September 25 2016.
Police appeal
Detective Constable Ross French from Fife’s Public Protection Unit said: “Lothian is a callous predator.
“He subjected children to horrific levels of sexual abuse and I can only hope that knowing he is now behind bars will offer them some sort of solace.
“We understand how difficult it is for those who have been subjected to sexual abuse to report it and I would like to make it clear to anyone affected by sexual abuse that time is no barrier for reporting crimes of this nature.”
