A Kirkcaldy sound engineer turned to dealing drugs in “desperation” after losing out on a contract with Sony, a court heard.
Daniel Herbert had been left in debt after the deal with the music giant had gone sour.
Kirkcaldy Sheriff Court heard the used the money he made through dealing speed went to ensure his children were fed.
Solicitor Joe Mooney, defending said: “Mr Herbert has said repeatedly to me he was desperate and its his position he had no option whatsoever.
“He just wanted to survive and feed his kids and said he made a stupid mistake.”
He said Herbert’s offending had been limited since 2010 and that he had told Mr Mooney: “I know I will never offend again – I was starving, cold and desperate and have committed no further offences”.
Speaking on his own behalf, Herbert added he had had to pay back the label after a planned tour was cancelled.
He said he had asked the Citizen’s Advice Bureau for help before turning to supplying drugs to make money.
The nature of the contract with Sony and the sums involved were not disclosed in the court.
Sentencing
Herbert, of Links Street, Kirkcaldy, pled guilty to being concerned in the supply of amphetamine on September 14 2020.
Sheriff Robert More said Herbert had been found with a large amount of the Class-B drug.
He said: “The law is clear that those who deal drugs for any reason, for whatever motivation, will be dealt with severely.
“You also have a record that does you no favours.
“The sentence available to me goes up to three years imprisonment.”
However, he added Herbert was entitled to a discount to reflect the fact he had pled guilty at an early stage.
Herbert was jailed for 12 months.
