Monday court round-up — Spitting sweeties and touring Kelty at 10mph

A 34-year-old Fife man has admitted acting in a culpable or reckless manner by exposing part of his penis to a woman.

David Cotton appeared from custody to plead guilty to the offence which happened in St Ronan’s Crescent, Lochore, on December 20 last year.

Procurator fiscal depute Azrah Yousaf said the Crown accepts there is no significant sexual element to his actions.

Defence lawyer Stephen Morrison said his client, of Lochleven Road, Lochore, has nothing in his criminal record of this particular nature.

Sheriff Garry Sutherland deferred sentence until June 28 to obtain background reports.

Cotton was released on strict bail conditions.

Polyamorous rapist

A children’s mental health counsellor who once boasted of his life as a man with multiple partners has been jailed for rape. Morgan Prior, 33, was convicted of sexual assault of one former partner and the rape of another following a week-long trial at the High Court in Dundee.

Spitting mad

An Angus granny has admitted slapping a schoolgirl who she accused of “spitting sweeties” at her windscreen.

Carol Simpson was a passenger in a Ford Kuga which had to perform an emergency stop when passing schoolgirls, aged 13 and 14, in Forfar.

Simpson got out the car on Castle Street and asked if either of them spat a sweet at the vehicle.

After being told “no”, Simpson followed them out of view of others in the car.

Fiscal depute Sam Craib said the younger girl felt her hair being grabbed from behind, then Simpson struck her face four or five times.

The girl ran off and her face was still reddened when police spoke with her.

Simpson, 54, admitted the September 18 2022 assault.

At Forfar Sheriff Court, defence solicitor Michael Boyd said: “The emergency stop was made.

“One of the children spat sweeties at the windscreen of the car.

“She accepts to a certain extent that she overreacted.

“She said on this day she wasn’t feeling well.

“She accepts she should not have reacted in the manner that she did.

“This appears to be a moment of madness.”

Sheriff Mark Thorley deferred sentencing for six months for Simpson to be of good behaviour.

Death driver remanded

An estate worker who caused the death of a Dundee man and fled from the scene after driving dangerously on a country road has been remanded.

Head gamekeeper Jonathan Graham – know as Jonny – was thrown from the car when it left the road near the shoreline of a sea loch in the Ormsary area of Argyll.

Jonathan Graham and Jasmine Herron were killed by dangerous driver Jordan Lawrence.

The 37-year-old – originally from Dundee – and fellow passenger Jasmine Herron, 19, were both killed in the tragedy in January 2020.

The car’s driver, Jordan Lawrence, 25, had been drinking at a party for the end of the shooting season at Ormsary Estate, near Lochgilphead, when he lost control of the vehicle near the single track B8024.

Slow tour of Kelty

Kelty motorist Calan Houston, who drove home at 10mph while high on ketamine has lost his licence for 12 months after admitting driving while unfit through drink or drugs on January 29.

At Dunfermline Sheriff Court, he was also fined £320.

Fiscal depute Amy Robertson explained that another motorist found the 21-year-old parked diagonally across the road in a private-plated car at 5.45pm.

The driver suspected him to be under the influence and followed him as he began driving around Kelty at 10mph.

They contacted police who arrived and blocked Houston’s path near his home at John Smith Place.

He admitted taking ketamine earlier that afternoon but could not provide a sample as he was terrified of needles.

His solicitor Alan Jackson said the incident had been a wakeup call and his client, a first offender, has already sold the car.

Neighbourhood joyrider

A Milnathort man crept into his neighbour’s home through a back window and took his car for a joyride. Brazen thief Stephen Boyle, who also stole containers of cash, later returned to the man’s door and told him: “Here’s your spare car keys back.”

Perth Prison inmate Brandon Stewart, 23, has had his sentence extended after attacking another prisoner.

He assaulted Michael Williamson on April 17 last year by repeatedly punching him on the head in a cell doorway, in view of CCTV cameras, while he spoke to a third man.

A solicitor explained Mr Williamson had been “noising up” Stewart and had made a comment about what he would do to the third man’s family.

Sheriff William Wood imposed a three-month consecutive prison sentence.

As he was led away, Stewart said: “I’m sure we’ll see each other again.”

Stalkers

A woman and her new girlfriend who spent months stalking her former partner have appeared in court together to admit the campaign of abuse. Lauren McDade and Rebecca Marnie plagued the woman by threatening and abusing her at numerous locations around Dundee last year.

Dundee thug

A domestic thug from Dundee has avoided imprisonment for his latest attack on a partner.

In April, jurors at Forfar Sheriff Court convicted Daniel Mudie of a  July 2021 assault in Dundee’s Helmsdale Place by striking her on the head to her injury.

He returned to the dock on Thursday to be sentenced following the completion of social work reports.

Sheriff Krista Johnston placed Mudie on a community payback order with a year’s supervision.

He must complete 150 hours of unpaid work in that time.

His victim will also be protected by a non-harassment order which prohibits Mudie from contacting her for a year.
