A Dundee drink-driver yelled “beasty b*****d” at a Sheriff straight after his lawyer advocated for him to be kept out of jail for shouting similar abuse at police officers.
Solicitor Douglas McConnell tried to convince the court his client, Stanley Marnie, “turns into something he’s not” after drinking alcohol, and claimed this was to blame for him abusing the officers on August 28.
The 31-year-old had stolen a van and driven it when he was around five times over the drink drive limit.
Mr McConnell said: “The behaviour is clearly linked to misuse of alcohol.
“He turns into somebody he’s not, usually, when he drinks alcohol and he knows he has a problem.
“When he has a drink he takes things to extreme lengths.
“It is not an excuse, however, a custodial sentence isn’t in the best interest of the public. Mr Marnie is aware of his difficulties and wants to combat them.”
Marnie, of Kilberry Street, was initially apologetic and admitted his behaviour had been “disgusting”.
However, his demeanour changed when Sheriff Alastair Brown told him he would be going to prison after all.
He became agitated, shouted and threw punches at the dock, leading to a police officer to step in to escort him to the cells alongside court security.
Marnie had pled guilty to charges of stealing a van, driving with excess alcohol (109 mics) trying to spit on two police officers and behaving in an aggressive manner in the cage of a police vehicle by headbutting and kicking it, swearing and threatening the officers with violence.
The court heard he yelled “F**k off, f**k off you beasty b******s, I will f*****g kill you.”
All offences took place on August 28 at Kilberry Street.
Marnie had been a passenger in the van, which was being driven by another male, the court was told.
The driver got out due to an “altercation” between males in the street, leaving the accused alone in the vehicle with the keys in the ignition.
Marnie then drove away and was traced by police officers, who could smell alcohol on his breath.
Sheriff Brown disqualified him from driving for two years and jailed him for eight months.
