A Kirkcaldy man was warned he faced being jailed if he refused to accept a supervision order by a sheriff after admitting a drunken rammy.
John Stewart originally appeared from custody and pled guilty to acting in a threatening or abusive manner at an address on Valley Gardens in November.
The 25-year-old, of Chestnut Gardens, shouted and swore after his pregnant former partner told him to pack his belongings when he turned up at her flat, drunk.
He appeared for sentencing at Kirkcaldy Sheriff Court this week where his defence solicitor said he was not prepared to undertake a supervision order.
Christine Hagan added: “He has indicated that he’s not quite ready to seek help for the underlying issues relating to his drinking.”
But Sheriff Alastair Thornton said: “I’m not going to negotiate with him. It’s supervision or prison.”
Following a short adjournment, Russell changed his mind and agreed to accept a community payback order with 12 months supervision.
Sheriff Thornton warned: “You must comply with all reasonable directions from your supervising officer.
“If you don’t and you are found to have breached the order, then it will be open to me to revoke it and send you into custody.
“I don’t want to do that and you don’t want me to do that.”
Depute fiscal Nicola Henderson said: “The accused returned to the property under the influence of alcohol.
“He pushed the buzzer and his partner allowed him access to the building. She immediately noticed that he was drunk and had a bottle of Buckfast on him. She told him to pack his belongings and to leave.
“The accused sat on the sofa in the lounge and insisted that they talk. His partner repeated that she wanted him to leave. The accused went towards the front door and placed his body against it, preventing the complainer from opening it.
“She shouted ‘get off’ which was heard by others nearby and the complainer became increasingly upset by the accused’s drunken behaviour.
“She managed to pull him away from the door and he exited into the communal stairwell where he shouted things.”
Worried neighbours called the police and Stewart was arrested a short time later.
