Man who shook genitals and caused chaos at Dundee bar avoids jail

A drug-fuelled man who exposed himself while standing over a patron in a busy Dundee bar has walked free from court.

Paul Boyack also hurled a wooden baton at a man after a drugs and alcohol binge, which caused him to act in a “boorish” manner at the Balcony Bar.

Dundee Sheriff Court heard the 22-year-old was shaking his private parts at people in the bar and even “stood over a member of the public” while exposed.

The person complained about it but Boyack continued his bizarre behaviour.

Boyack then fled the pub with co-accused Kevin O’Donnell and the duo got into a car parked nearby, despite O’Donnell being disqualified following a dangerous driving conviction.

O’Donnell, 26, led police on a high-speed chase through the city centre, narrowly avoiding hitting a woman with a pram.

He was previously jailed for 12 months, while Boyack was placed on a curfew for nine months.

Solicitor Ross Donnelly, advocating for Boyack, said: “With regards to the public indecency charge, his position is that this was boorish behaviour.

“It was unacceptable behaviour, drunken nonsense, but it was not sexually motivated.

“He is someone who does not make a habit of consuming alcohol and drugs, but on this occasion he was was on what he described as a ‘binge’.

“He accepts it caused distress and alarm to people within the  premises.

“He has refused to accept an unpaid work order so he accepts this ties your Lordship’s hands.”

Boyack, of Fairbairn Street, Dundee, pleaded guilty on indictment to charges of public indecency and assault at the Balcony Bar, Ward Road, on January 12.

He also admitted repeatedly contacting his former partner by text, attending her home and repeatedly shouting for her on January 21 when he was banned from contacting her by a bail order.

Sheriff Alastair Carmichael ordered Boyack to remain within his home address between 7pm and 7am, warning him that if he breaches the order he is likely to be jailed.
