The father of a tragic tot shaken to death by another man was today jailed after he admitted chasing a homeless man in Dundee before his friend robbed him.
Kevin Flood – whose daughter Hayley Davidson was killed by her mother’s new partner Gordon McKay in 2016 – was handed a nine month sentence after he admitted a charge of breach of the peace over an incident in Soapwork Lane on June 21.
Flood – who was only released from a jail sentence for a housebreaking rap weeks before the incident – chased Kevin Docherty as he walked towards his grandmother’s house.
His co-accused Scott Flynn then tripped up Mr Docherty and took him to the ground, punching and kicking him before stealing £105 in cash and the victim’s mobile phone.
Fiscal depute Eilidh Robertson told Dundee Sheriff Court that Flood later said the attack had occurred because Mr Docherty had had sex with his ex partner.
Miss Robertson said: “Several females had followed the accused and complainer and shouted at Flynn to stop, which he then did.
“Both accused walked away and the complainer ran in to the city centre.
“One of the females could see he was crying.
“The complainer was ultimately traced begging in Dundee city centre later that afternoon.
“He was dishevelled and upset.”
Flynn, 32, a prisoner at HMP Perth, pleaded guilty on indictment to a charge of assault and robbery, while Flood, 27, also a prisoner at Perth, admitted a charge of breach of the peace.
Sheriff Alastair Carmichael jailed Flood for nine months.
Flynn was given a 16 month sentence to be served consecutively to a 100 day period of recall for his licence on a previous jail term.
The sheriff then reduced that sentence to six months to take into account the period of time he has spent on remand.
Hayley Davidson died in hospital on February 17 2016 after allegedly being the victim of assaults on various occasions over the course of the previous five months.
Gordon McKay, 38, denied a charge of murder and instead admitted a charge of culpable homicide over her death.
He initially told his 27-year-old partner, Catherine Davidson, that Hayley was injured after wriggling off a beanbag when he left her alone to run a bath. 
But he later admitted to police he had shaken her “three or four times”, resulting in her head “whipping backwards and forwards”.
Scans revealed Hayley had a bleed on the brain. She was taken off life support three days after the incident, on Valentine’s Day 2016, at McKay’s home in Buckhaven, Fife.
Lord Uist jailed McKay for seven-and-a-half years.
