A COUPLE were living together for a month in the same house despite a bail condition banning the man from contacting his partner.
John Dewart, 28, of South Road, admitted the offence when he appeared from custody at Dundee Sheriff Court.
Fiscal depute Trina Sinclair said the pair had been in a relationship for almost two years but following an incident for which he had been placed on petition, Dewart had been charged and had been granted bail on the special condition that he didn’t approach or contact his partner, Claire Johnstone.
When police went to her home in Brackens Road on another matter, the accused answered the door and said Ms Johnstone was at work.
Police were unaware of the bail condition at the time.
Solicitor Douglas Williams said Ms Johnstone had moved house and had twice written to the court to have the bail conditions lifted. Because the accused had heard nothing else regarding the petition, Dewart had assumed they had been lifted.
He handed himself in to police when he found out they were looking for him.
Sheriff Lorna Drummond deferred sentence until February 26 for reports and a restriction of liberty assessment, ordering Dewart not to contact his partner again unless it was confirmed to him that the court had granted any alterations to the bail condition.
