A fatal accident inquiry is set to take place into the death of a man in an industrial accident in Dundee.
Mark Burry, 49, from Carnoustie, was a forklift driver at oil equipment supplier Rigmar, based at Dundee Port.
The former Kirkton man was killed while working at the company’s premises on February 12 last year at Prince Charles Wharf.
His brother Nobby Burry previously told the Tele he believed Mark was killed by a falling pipe in “an accident”.
Following an investigation by the Health and Safety Executive, the Crown Office has now confirmed that an initial hearing will be held at the end of next month — when it’s likely dates will be set for the full inquiry.
It will look into the circumstances surrounding the incident that claimed Mark’s life.
The remit of an FAI, normally held in front of a sheriff, is often to see whether any “reasonable precautions” could have been taken to prevent a death from occurring.
It can also determine if there were any defects in the system of working that contributed to a death.
The preliminary hearing will be held at Dundee Sheriff Court on July 31.
In the aftermath of the incident, Nobby said that workers at the site had been unloading pipes at the time of the accident involving his brother.
He claimed that the pipes were being stacked on a rack, but a strap holding them broke.
It was believed that Mark, who wasn’t in a forklift at the time, was killed instantly when one of the pipes struck him.
Mark had worked at the site for about 10 years and was said to have been comfortable with the risks of working with heavy items.
Nobby said his brother was a “cheery and happy” person and he also described him as a “family man through and through”.
At the time of the incident, Rigmar confirmed a man had died on its premises but declined to comment any further. A spokeswoman said today: “We decline to make comment at this time.”
Rigmar Fabrication arrived in Dundee in 2012 after acquiring Riverside Engineering. It then grew its presence to occupy a 15-acre site at Prince Charles Wharf.
