A man who was jailed for taking part in a sex act on a Dundee bus has had his bid to be taken off the sex offenders register rejected.
Garry McNair, along with co-accused Alexis Watson, pleaded guilty to public indecency at Dundee Sheriff Court and were each sentenced to five months’ imprisonment, as well as being put on the register.
The pair admitted committing a sex act on a public bus, in broad daylight, in front of other passengers, including children on September 9 last year.
Dundee Sheriff Court heard that McNair was “revelling” in the act and was giving a show of “bravura”, and that shocked passengers confronted the couple, who ignored the requests to stop.
CCTV recorded the act taking place in the back row of the bus and police officers were able to later trace the pair.
McNair’s appeal stated that the two requirements – that the indecent act had a significant sexual aspect, and that someone under 18 was involved in the incident – needed for him to be put on the sex offenders register had not been met. However the appeal judges felt that the right decision was made by the Dundee sheriff and McNair’s appeal was refused.
