A man threw a glass bottle at his neighbour moments before his friend held up a knife and threatened to kill the same neighbour.
Dylan Lynch, 32, and Daniel Perrie, 28, were ordered at Dundee Sheriff Court to carry out unpaid work after admitting their roles in the incident.
The row took place when Kaspars Austrups, 28, of Balunie Drive, asked Lynch — who lives in the flat directly below him — to turn down music.
Lynch responded by throwing a glass cider bottle at Mr Austrups and Perrie, of Lower Pleasance, appeared with a large kitchen knife and threatened to kill Mr Austrups.
Fiscal depute Eilidh Robertson told the court there had been an ongoing dispute between the neighbours.
The fiscal said: “At 11pm on October 4 last year the complainer could hear music, singing and screaming coming from the accused’s flat.
“He went down to complain as he was planning on going to bed.
“The accused’s girlfriend opened the door and a scuffle broke out between her and the complainer, with both throwing punches. Both accused approached and Lynch threw a glass cider bottle at the complainer.
“He moved away and it smashed against the wall behind him.
“Lynch then punched the complainer, connecting with his face. Perrie appeared behind Lynch and presented a knife, holding it up with the point towards the complainer, and shouted. Mr Austrups ran up to his own flat and closed the door. He then heard a loud thud on his door and heard Perrie shout, ‘I’ll kill you’.
“When police arrived they noted the smashed bottle in the close and a stab mark on Mr Austrups’ front door.”
Solicitor Anika Jethwa, defending Perrie, said: “My client was unaware of the background between these two neighbours. His perception at that time was that a strange man was trying to get in to the house he was in and he reacted in the way he did. He accepts he over-reacted and says it is the worst thing he has ever done.”
Perrie admitted behaving in a threatening or abusive manner by brandishing a knife at Mr Austrups, threatening to kill him, shouting, swearing, and stabbing the front door of his home.
He was ordered to complete 200 hours of unpaid work, placed under supervision for a year, and placed on a curfew for 31 weeks, confining him to his home between 7pm and 7am.
Lynch admitting assaulting Mr Austrups by punching him on the head and throwing a glass bottle at him, on the same date and location.
He was ordered to complete 120 hours of unpaid work within the community.
