A bus driver who took his life following a crash which left a man seriously injured has been cleared of any wrongdoing in court.
Ali Elbuzedi was injured after being involved in a collision with a single-decker bus driven by Filep Myzylowskyj in March 2012.
The crash, on Dundee’s Commercial Street, happened after Mr Elbuzedi stepped on to the road and was hit by the number 22 National Express service.
Mr Myzylowskyj took his life a matter of months after the crash having struggled to come to terms with the incident.
In the aftermath of the crash, the bus driver’s family wrote to former Dundee West MP Jim McGovern to say they felt Mr Myzylowskyj did not received proper care and support from National Express.
On Tuesday, at a hearing at Edinburgh’s Court of Session, a judge ruled no action taken by Mr Myzylowskyj could have prevented the crash from occurring.
Lord Matthew Clarke said that he had found no evidence to contest the view that: “There was nothing which the driver could, and should have done, in the exercise of reasonable care, which would have avoided the accident.”
Mr Myzylowskyj’s wife was too upset to comment at her home.
A spokeswoman for Xplore Dundee, who are owned by the National Express group, said: “This was a tragic incident and our thoughts go out to the families concerned.
“We accept the decision of the court and hope that this will allow closure for all parties involved.”
