A Dundee pervert who indulged in a solo-sex act at a Dundee retail park has been placed on supervision.
Michael Bajek pleaded guilty to engaging in sexual activity twice on September 13, last year.
Before horrifying customers outside The Range at the Stack Leisure Park in Lochee, Bajek wandered along Coupar Angus Road “fiddling” with his exposed privates.
The 36-year-old, who committed a similar offence in 2015, was banned from Dundee as part of his bail conditions and has been living in Blairgowrie.
He must now attend the Making Changes sexual offenders’ programme and live under the auspices of supervision for the next three years.
He has also been placed on the sex offender’s register.
Call to protect public
Sheriff Gregor Murray told Bajek: “Your previous convictions are a serious problem.
“The sentence I impose must protect the public.
“You are lucky your victim’s reaction was one of disgust.”
Seven years ago, Bajek admitted exposing himself in Dundee city centre in the early hours of the morning.
Solicitor Ross Donnelly explained alcohol was a significant factor in Bajek’s offending.
He said: “He understands reports will be required and he’ll be placed on the sex offenders register.
“There is a background, obviously.
“I understand he can explain steps he’s taken since this incident.”
Witness called police
Fiscal depute Laura Hogg explained that at 5.45pm, Bajek had walked past a woman while he was exposed.
She said: “A witness walking her dog became aware of a male walking towards her with his hands around his crotch area.”
Ms Hogg said the woman noticed Bajek was exposing himself as he walked past.
She turned and saw him fiddling with himself, using both hands, the court heard.
He walked off and she called the police.
Eye contact
Around 15 minutes later, Bajek arrived at The Stack.
Ms Hogg said: “Witnesses were standing outside The Range when the accused walked past them.”
She added that Bajek was still exposing himself.
“The accused made eye contact with one witness and sniggered,” she said.
“The accused walked away.”
Ms Hogg said he stopped after 50 yards, turned around and then started to carry out a sex act.
“The accused walked off and a witness took a photograph of him. Police were contacted and traced the accused at his home address,” she added.
