The Urban Beach in Broughty Ferry has been granted permission to sell alcohol in a new beer garden to the rear of the restaurant.
The popular business, previously named The Glass Pavilion, had faced several objections from nearby residents who feared it would create excessive noise.
But owner Paul Gallacher appeased locals after making clear he would abide by the conditions agreed at Dundee City Council’s licensing board.
The licence will allow the business, that lies along a stretch of the waterfront Esplanade, to sell drinks alongside an outdoor ice-cream shack and a children’s play area.
The bar/restaurant already has a large beach-facing terrace to the front popular with locals and tourists in the summer.
Earlier this year, Mr Gallacher withdrew a similar application — which included a request for televised sport — after local objections were raised over potential noise.
Under the licence agreed on Thursday, no amplified music is allowed to be played outside of the premises, front or back.
Drinking of alcohol until 10pm
Additionally, alcohol can only be consumed in the agreed outside area from 11am to 9pm, Monday to Sunday from September to June and 11am to 10pm, Monday to Sunday throughout July and August.
To allay any doubts in the minds of local residents, Mr Gallacher said: “We know the restrictions…and we’ll abide to these, we’ll definitely abide by everything that’s there.”
The council’s licensing standards officer, Paul Hogan, added further clarity about the decision.
He said: “The original application that came in earlier in the year, was about having extended hours and also for televised sports and the reinstatement of that area to (the) rear.
“There were objections and concerns about that. As a result of that the operator has withdrawn that application and the only thing that they are requesting now is the reinstatement of the area to the rear for the service of alcohol.
“But obviously that would be limited to the outdoor drinking times.”
‘Happy to go with planning’
Local resident, John Spink, who had expressed concerns about the original application said: “If it’s only the outside area, it’s fine. But when I look at the operating plan…that refers to licences about music, outdoor events, private functions etc.
“But we’re not entertaining that today and if it’s the basis that it’s only the operator hours then I’m happy to go with what is already in place with Dundee City Council and the planning.”
