A sex offender who told a court he was “heartbroken” after being accused of rape has been cleared by a jury.
Kieran Dorian, who is subject to a life-long Sexual Offences Prevention Order (SOPO), had been accused of forcing himself on a woman who had withdrawn consent in March 2021.
The convicted stalker wept as he gave evidence during his trial – dubbed a “performance” by fiscal advocate Derick Nelson.
A jury of seven women and eight men spent around four hours deliberating following the two-day trial at the High Court in Dundee.
They returned a majority verdict of not proven, meaning Dorian was not convicted of any crime.
Sobs and denials
During his evidence session, Dorian was asked how being accused of rape had made him feel, to which he responded, among spurts of tears, “heartbroken, it made me feel ill”.
He told the court he had engaged in consensual sex with the woman – who cannot be named – at a property on Parker Street in Dundee in March 2021.
After telling the court his body had “given up” and the act was finished, he said he remained at the address for several hours, spending cash on breakfast and a curry and watching the Six Nations rugby on his phone.
Dorian, who was jailed for three years in 2019 for bombarding his own social worker with creepy texts and phone calls, admitted he was not sexually experienced.
He said his accuser had “taken him under her wing.”
When asked outright if he had raped her, Dorian sobbed “no f***ing way”.
He was reprimanded by Judge William Gallagher for using language which would offend the court.
Past crimes
Under cross examination by fiscal advocate Derick Nelson his tears were branded an act.
Mr Nelson added he “switched his emotions off like a tap” during questioning by the prosecution.
Charges against Dorian – listed on court papers as a prisoner at HMP Perth – of possessing cannabis and assault were withdrawn by the Crown before the jury were sent to deliberate.
In January 2019, Dorian was finally jailed for three years after he bombarded the social worker tasked with monitoring his behaviour with filthy phone calls and texts.
He also admitted stalking another woman for more than three-and-a-half years after becoming obsessed with her and harassing her online and in person.
The two victims were the fifth and sixth women he admitted stalking over the previous seven years, having targeted four others in 2017.
He was jailed again in June 2021 for starting a secret, banned relationship with an unsuspecting woman, against the terms of his SOPO imposed in 2017, which forbade him from forming any relationship with a woman without advising his supervising officer.
